Explore the benefits of Casablanca Finance City (CFC) status: 5-year corporate tax exemption, reduced 20% rate, flat income tax for employees, and streamlined mobility. A full guide on tax advantages, eligibility criteria, and the application process to obtain this attractive status in Morocco.

Casablanca Finance City (CFC) is strategically positioned as a financial and economic hub at the crossroads of Africa and Europe. This unique status offers businesses substantial advantages, particularly in terms of taxation, aiming to stimulate investment and the development of financial and service activities across the African continent.

Managed by the Casablanca Finance City Authority (CFCA), this financial center is a driving force for the Moroccan economy, fostering synergies and business opportunities for its members. Many multinationals have already established their regional headquarters here, leveraging its dynamic ecosystem.

To assist you in obtaining CFC status or with the creation of your company in Morocco, iHub, a member of the Order of Chartered Accountants, offers its expertise. We also provide accounting services and consulting for companies operating in offshoring and nearshoring services.

Strategic Advantages of Casablanca Finance City Status

CFC status provides several key benefits for companies choosing to establish themselves there. These advantages are evident in both operational and fiscal aspects.

Facilitating Business Operations

CFC simplifies administrative procedures through a "one-stop shop" approach, making the business environment particularly fluid.

  • Simplified Mobility for Individuals: CFC companies benefit from an accelerated process for recruiting foreign personnel. They are exempt from the ANAPEC certificate, and recruitment authorization is guaranteed within 3 working days, with no requirement for candidates to produce diplomas.
  • Free Mobility of Capital: Companies established in CFC enjoy great flexibility in managing foreign currencies. They can open foreign currency accounts, freely dispose of their foreign-sourced funds, and benefit from enhanced allowances for business travel.
  • Dynamic Business Network: CFC actively promotes its community of over 200 leading companies as a major competitive advantage. This community, present in more than 50 African countries, fosters synergies through monthly events and a digital communication platform.
  • Dispute Resolution: An international mediation and arbitration center in Casablanca offers an alternative tool for dispute resolution.

Significant Tax Advantages

Despite recent regulatory adjustments to align Morocco with international standards, CFC status maintains competitive tax advantages, especially when compared to the common law regime.

Regarding Corporate Income Tax (CIT)

  • Total Exemption: CFC companies benefit from a total CIT exemption for the first five consecutive fiscal years, starting from the first year of status grant. For companies incorporated after January 1, 2023, this exemption ends after the first 60 months following the incorporation date.
  • Reduced Rate: Beyond the exemption period, a reduced CIT rate of 20% is applied, regardless of the profit amount. CFC companies are not subject to the 35% rate applicable to very high profits.
  • Minimum Contribution: Like any new company, a CFC entity is exempt from the minimum contribution for the first 36 months of its operation, with a limit of 60 months after its incorporation. Thereafter, the minimum contribution is 0.25% of the taxable base, with a minimum of 3,000 MAD.

These tax advantages begin from the date the CFC status is granted by the dedicated commission.

Regarding Income Tax (IR) for Employees

Employees of CFC companies have the option to choose an Income Tax (IR) at a flat rate of 20%.

  • This rate applies to gross salaries, allowances, monetary or in-kind benefits, and any other compensation received.
  • The option for this flat rate is granted for a maximum period of 10 years from the decision to grant CFC status or the employee's start date.
  • Employees can choose the common law regime if it is more advantageous for them.

Other Tax Advantages

  • Foreign-Sourced Dividends: Exemption from withholding tax on foreign-sourced dividends paid to non-resident beneficiaries.
  • Registration Duties: Exemption from registration duties on capital operations (this measure has been generalized to all companies).

How to Obtain Casablanca Finance City (CFC) Status?

The granting of CFC status is a structured process, managed by the Casablanca Finance City Authority (CFCA) and validated by the governmental authority responsible for finance.

Eligibility Conditions

To be eligible for CFC status, a company must meet several essential conditions:

  • Be duly incorporated in Morocco, or commit to finalizing its legal incorporation within six months following the notification of provisional status grant.
  • Have its effective registered office and main activities within the CFC zone.
  • Submit a detailed activity program, demonstrating the economic substance of the company (staff, budgets, business model). Representative offices are exempt from this commitment.
  • Provide solid guarantees regarding its organization, technical means, as well as the experience and integrity of its executives.
  • Comply with current legislation and regulations, particularly concerning foreign trade, exchange, and the fight against money laundering and terrorist financing. iHub can provide legal advice to ensure this compliance.
  • Commit to respecting the CFC code of ethics.
  • Agree to submit to CFCA all documents and information it requests to ensure compliance with the commitments based on which CFC status was granted.

Application Procedure

The application for CFC status must be addressed to CFCA by an authorized person from the company. The dossier typically includes:

  • A CFC status application form.
  • A letter of intent.
  • A document attesting the applicant's authority to represent the company.
  • A list of shareholders and ultimate beneficial owners.
  • Identity documents and CVs of individuals holding management positions.

CFCA publishes the complete list of required documents, adapted to the company's activity type, on its website.
