Understanding Employment Contracts in Morocco: CDD and CDI

In Morocco, the legal framework for employment is primarily governed by the Labor Code (Law 65-99), which aims to balance the rights and obligations of both employers and employees. The main distinction lies between the Indefinite-Term Contract (CDI), which is the norm, and the Fixed-Term Contract (CDD), considered an exception. Understanding these nuances is crucial for any company operating in the territory.

What is an Employment Contract?

An employment contract is an agreement by which an individual undertakes to perform work for a company or employer, under their direction and control, in exchange for remuneration. This contract can be established in writing or verbally. However, for the legal security of both parties, drafting a written contract is strongly recommended. This helps clarify the terms of employment and serves as proof in case of disagreement or dispute. The CDI: The Principle of Stable Employment Relationships

Characteristics and Benefits of CDI

The Indefinite-Term Contract (CDI) represents the standard form of employment in Morocco. As its name suggests, it does not specify an end date, symbolizing a stable and lasting employment relationship. Any employment relationship that does not explicitly fall within the restrictive criteria of the CDD is, by default, considered a CDI (Article 16 of the Labor Code).

The advantages of the CDI are numerous, both for the employee and for the overall employment relationship:

  • Job Stability: Offers long-term security to the employee.
  • Enhanced Protection: Ensures rights in case of dismissal, including notice period and compensation.
  • Acquisition of Seniority: Allows the employee to benefit from advantages related to their seniority.
  • Access to Social Benefits: Generates continuous access to benefits from the Caisse Nationale de Sécurité Sociale (CNSS).

The CDD: The Regulated Exception

Specific Cases for CDD Use (Articles 16 to 18)

The Fixed-Term Contract (CDD) is only authorized in specific circumstances defined by law, reflecting its exceptional nature. It is intended for temporary business needs:

  • Temporary Replacement: To cover the absence of an employee whose contract is suspended (e.g., illness, maternity, leave).
  • Temporary Increase in Activity: To meet a punctual, non-structural increase in workload.
  • Seasonal Work: For jobs related to specific seasonal cycles.
  • Launch of a New Business or Product: During the first opening of a company or establishment, or for the initial launch of a new product or service.

Duration and Renewal of CDD

The maximum duration of a CDD is set at one year and can only be renewed once. Beyond this framework, the contract is automatically reclassified as a CDI, granting the employee all associated rights, including seniority calculated from the beginning of the initial CDD.

A notable exception concerns the agricultural sector, where the CDD can be established for a duration of 6 months, renewable, without exceeding a total period of 2 years. Beyond this, it also transforms into a CDI.

Essential Clauses of an Employment Contract

Although the Labor Code does not exhaustively list all mandatory clauses, a well-structured and compliant employment contract should include the following elements to ensure its validity and the clarity of the relationship:

  • Full identification of the parties (employer and employee).
  • Start date of the contract execution.
  • Nature of the contract (CDI or CDD) and its duration if fixed.
  • Position held, detailed functions, and responsibilities.
  • Main workplace and, if applicable, remote work arrangements.
  • Working hours (weekly schedule).
  • Remuneration structure (basic salary, bonuses, benefits in kind).
  • Duration of the probationary period and its renewal conditions.
  • Notice period conditions in case of contract termination.
  • Reference to the applicable collective agreement (if any).
  • Specific clauses (non-compete, confidentiality, mobility, etc.).

Reciprocal Obligations: Employer and Employee

Employer's Obligations

The employer is bound to respect several commitments towards their employee:

  • Provide an adequate working environment and the necessary tools for task execution.
  • Pay the agreed salary within the stipulated deadlines.
  • Ensure a safe and healthy workplace, in accordance with Articles 281 to 303 of the Labor Code.
  • Declare the employee to the CNSS and settle contributions on time. Payroll management, including payslips and social and tax declarations, can be optimized through outsourced accounting services with experts like iHub.
  • Issue a work certificate at the end of the contractual relationship.
  • Prohibit all forms of discrimination and preserve the employee's dignity.

Employee's Obligations

The employee also has duties towards their employer:

  • Execute assigned tasks diligently and professionally.
  • Adhere to the company's internal regulations.
  • Take care of the equipment and assets provided.
  • Observe the confidentiality of company information.
  • Comply with established health and safety rules.

Suspension of Employment Contract (Article 32)

An employment contract can be temporarily suspended without the relationship being terminated. During this period, the employee generally retains their seniority rights. Cases of suspension include:

  • Mandatory military service.
  • Work stoppage due to illness or accident (with justifications).
  • Maternity leave.
  • Temporary incapacity resulting from a work accident or occupational disease.
  • Participation in a legal strike.
  • Temporary legal closure of the company.
  • Disciplinary layoff.

Hiring Foreign Workers in Morocco

The employment of foreign nationals is subject to specific regulations:

  • Mandatory obtaining of a work permit validated by ANAPEC.
  • The position must not be fillable by a Moroccan candidate.
  • The employment contract must be endorsed by the Ministry of Employment.

The permit is valid for one year and is renewable. Non-compliance with these provisions can lead to penalties for the employer. For specific advice on these procedures, feel free to request our Legal Advice services.

Conclusion

Moroccan labor law provides a structured framework for employer-employee relationships, with clear distinctions between CDI and CDD. A thorough understanding and rigorous application of these rules are essential for legal compliance, dispute prevention, and maintaining a healthy and productive work environment. iHub supports you in ensuring the legal security of your hires and the proper management of your social obligations.
